Terms & Conditions
These Terms & Conditions (“Terms”) govern your use of selican.ai and the services of Selican AI Powered Marketing (“Selican,” “we,” “us”). By using our website or services, you agree to these Terms.
1. Services
Selican provides marketing and communications services for businesses, including an AI receptionist and web chat assistant (“Pete”), website and app development and hosting, social media management, email marketing and database reactivation, an AI-powered CRM, business phone and texting, professional email and website visitor identification. The specific services you receive depend on your plan and any add-ons.
2. Eligibility
Our services are for businesses. You must be at least 18 years old and authorized to bind your business.
3. Plans, billing and add-ons
- Plans are billed monthly plus a one-time setup fee, as listed on our pricing page.
- Add-ons are available only together with a plan and are never sold on their own.
- Fees are due in advance and are non-refundable except as stated in these Terms or required by law.
- Usage limits (such as AI call minutes, texts and emails) apply as described in your plan.
4. Setup
Setup typically takes about 7 days, including build and testing, and depends on you providing information and access we need.
5. Term and cancellation
You may cancel anytime within the first 60 days of service. After 60 days, your plan continues for a yearly term and you may cancel effective at the end of each yearly term. Setup fees cover work already performed.
6. Your data and recordings
You own your call recordings, contacts and customer data. We process them to provide the services. On cancellation, you may request an export of your data.
7. Your responsibilities
- You are responsible for your own compliance with laws that apply to your business, including call-recording consent laws, telemarketing rules (such as the Telephone Consumer Protection Act and Do-Not-Call rules), text-messaging rules and carrier requirements, email laws (such as CAN-SPAM) and privacy laws.
- You will only upload contacts you have the right to contact, and you will provide any consents and disclosures required.
- You will provide accurate business information for Pete's knowledge, pricing and policies.
8. Acceptable use
You may not use our services for unlawful, deceptive, harassing or harmful purposes, to send unsolicited messages without required consent, or to infringe anyone's rights.
9. AI limitations
Pete and other AI features generate responses automatically and can make mistakes. AI output should not be relied on as professional, legal, safety or technical advice. Pete discloses that it is an AI assistant and shares only information you provide. You should review important conversations and bookings.
10. No guarantee of results
We do not guarantee any particular number of calls, leads, bookings, reviews, rankings or revenue. Industry figures and calculators on our site are illustrations only.
11. Intellectual property
Our website, software, content and brand, including Pelican Pete™ and the Selican Family™ (Poppy, Mojo and Margo), are owned by Selican AI Powered Marketing. You may not use them without our written permission. Content you provide remains yours; you grant us a license to use it to provide the services.
12. Third-party services
Our services rely on third-party providers (such as telephone carriers, hosting and social platforms). We are not responsible for their outages or policy changes.
13. Disclaimer
Except as expressly stated, the services are provided “as is” and “as available,” without warranties of any kind to the extent permitted by law.
14. Limitation of liability
To the extent permitted by law, Selican will not be liable for indirect, incidental, special, consequential or punitive damages, or lost profits or revenue. Our total liability for any claim is limited to the fees you paid us in the three months before the claim arose.
15. Indemnification
You will defend and indemnify Selican against claims arising from your content, your contact lists, your violation of law or these Terms.
16. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Before filing a claim, each party agrees to try to resolve the dispute informally for 30 days by contacting the other. Any unresolved dispute will be brought in the state or federal courts located in Sacramento County, California.
17. Changes
We may update these Terms. We will post changes here with a new “Last updated” date. Continued use after changes means you accept them.
